Terms of Service

We have developed a website (“the Website”) where we sell our product(s) being preowned computer hardware, mobile devices, and other preowned hardware devices and peripherals (“the Product(s)”). 

By using the Website, you agree to be bound by all terms and conditions herein and any updates from us from time to time.

The displayed Purchase Price on the Website is the amount payable which payment will be made online.

Products are displayed on our Website with the following conditions:

FAIR

Exterior: Vsible signs of wear such as scratches, small speck-like markings, and small dents on the body. The screen contains small, noticeable scratches on or around the display. The price considers minor external flaws that do not affect the device’s functioning.

Functionality: The device has passed a thorough testing process and performs to the tested level of functionality. Battery capacity of 80% and upwards for phones and tablets.

GOOD

Exterior: Moderate signs of wear with light surface scratches on the body and exterior and, in the case of laptops, shiny keys and surfaces around the keyboard. Hairline scratches to the screen that are barely noticeable.

Functionality: The device has passed a thorough testing process and performs at a similar level to a new device. Battery capacity of 85% and upwards for phones and tablets.

EXCELLENT

Exterior: The device can reasonably be considered similar to new. Barely noticeable markings on the body and exterior such as hairline scratches. The screens are unmarked. 

Functionality: The device has passed a thorough testing process and performs at a similar level to a new device. Battery capacity of 85% and upwards for phones and tablets.

Return and Warranty

Unboxxed provides a 14-day return policy from date of delivery where you can return the Products to Unboxxed for any reason including a ‘change of mind’ or the Products do not comply with the condition description or any other reason and where you can claim a full refund or exchange the Product for the same or similar Product at the same or similar price or a credit note at your election. The Products must be in their original packaging, include all cables, batteries and other accessories. Payment of a refund on a 14-day return will be within 14 days of Unboxxed having received the product back at its facility. 

After 14 days, you will be deemed satisfied with the Product.

We also provide a 1-year warranty on all Products calculated from date of delivery. Repairs will be attended to within 14 days of delivery to Unboxxed or Unboxxed will replace the Product (in the event that it cannot be repaired) with the same or similar Product at the same or similar price. In the event that the Product cannot be repaired or replaced, Unboxxed will refund you. For clarity, Unboxxed will not be responsible for any matter therein after the 1-year warranty period.

Unboxxed is responsible for all delivery costs occasioned.

Unboxxed will not be liable (in respect of the 14-day return or 1-year warranty) if the Product is damaged by use of non-Unboxxed parts or by accident or abuse or misuse (outside of its intended or permitted uses) or spillage of food or liquid or any other external causes including fire, or an act of God or the State, flooding, lightning, load shedding, improper voltage or power supply or repairs done without the approval of a representative of Unboxxed or cosmetic damage to the Products after delivery or defects or parts requiring replacement due to fair wear and tear.

Any product returned to Unboxxed without a valid 14-day Return or 1-year Warranty may be rejected, returned at your cost (subject to prepayment), capped to 5% of the price of the product, or kept for sixty (60) days and then be disposed of in sole discretion of Unboxxed with no further liability or obligation to you.

No other warranties are provided or implied.

All charging cables will be provided with the product. If there is any missing item, please notify us ASAP but same must be within the 14-days of delivery, failing which we will not be liable and you will be deemed satisfied.

Unboxxed does ensure the authenticity of the Products which includes ensuring that the Products are not stolen or counterfeit or illegally imported and endeavours to comply will all applicable laws. Notwithstanding the aforesaid and in the event of breach of the aforesaid, we reserve the right to take possession of such offending Products and replace or refund you or provide a credit note in our discretion.

Please notify us if the Product is not delivered within 5 days of the Purchase Price having been paid.

You undertake to engage meaningfully with us and not obstruct or hinder us in processing a refund, or warranty or any other matter therein. You also agree to deal with us professionally and not use any vulgar, sexist or racist language in corresponding/dealing with us.

We will not be liable for any inaccuracies/errors made by Unboxxed. We will not be responsible if any Product that is advertised for sale is not available or the price is changed prior to payment. 

Risk

The Products are used entirely at your own risk and we will not be responsible for any virus, corruption, loss of files, data, and any other damage or loss, injury, loss of life etc from using such Products and you indemnify us accordingly.

We shall service and maintain the website in conformity with all descriptions and specifications set out therein. The Website is supplied ‘as is’ without any implied warranty not specifically set out by us and is used by you at your own risk including any third party links and we will not be liable for any virus or corruption manifesting therein. Save for routine maintenance, we will use our best endevours to ensure that the Website remains ‘live’ at all times but cannot be responsible for any disruption caused by any lightning strikes, load shedding, corruption, malfunction, virus or any other cause of whatsoever nature beyond our reasonable control.

We will not be liable for indirect or consequential damages. Furthermore, we will not be held liable for any loss occasioned by errors or fraud or interception and processing an incorrect payment due to incorrect/fraudulent information being provided. You indemnify us accordingly.

Notwithstanding the above, should it be found that we are liable for any direct damages, such liability will be limited to R50,000.00.

General Terms

We will comply with all applicable laws including the POPIA Act and keep all your information secure and not disclose same to any third party, save for your details for purpose of delivery, returns and the warranty which you hereby consent to.  

We warrant that no aspect of the Website will infringe any patent, design, copyright, trade secret or any other proprietary right of any third party and we have obtained the necessary licences, consents, authority and permission to provide same.

All computer programmes, patents, trademarks, trade names, business names, get-ups and copyright (whether registered or unregistered) of Unboxxed are the property of Unboxxed.

The Parties agree to dealing with each other in the utmost good faith during the duration of this Agreement and on its termination.

Should either Party commit a breach of this agreement and fail to remedy such breach within 7 business days of having been called upon in writing by the other Party to do so, then the other Party may, in its discretion and without prejudice to its rights in this agreement, cancel this agreement and claim damages, alternatively proceed with a claim for specific performance and claim damages. In the event of breach of this agreement, we may in our discretion and without liability, terminate access to the Website. In the event of breach, either Party shall be entitled to claim all legal costs on an attorney/client scale, including counsel on brief and collection commission.

In the event of any dispute arising in terms of this Agreement, such dispute will be decided by way of arbitration to be held in Sandton. The arbitrator will be an advocate with at least 10 years experience agreed to in writing by the Parties within 7 days of the dispute arising. In the event that the Parties cannot agree on the aforesaid during such time period, the arbitrator will be an advocate with similar experience who will be appointed by the President of the Johannesburg Society of Advocates. The rules of the Arbitration will be that of the Expedited Rules of AFSA and the award will be final and binding on the Parties.  Nothing in   the aforesaid will prevent either Party approaching a court for urgent relief should they so      

Neither Party will be entitled to cede their rights in this agreement unless they have written permission from the other Party and which permission will not be unreasonably withheld.

Should any clause, paragraph or sentence be found to be invalid or void, it will be severed from the agreement and will not invalidate the whole agreement.

This agreement is to be governed and interpreted by the laws of the Republic of South Africa. This agreement is not to be interpreted against the drafter therein and clauses that by their nature survive termination shall remain binding on the Parties notwithstanding termination of this agreement.

All our devices are covered by a 1-year warranty, which covers defects in materials
and workmanship, ensuring the device functions properly.
This may include:
The warranty is non-transferable and applies only to the original buyer who
purchased the product from Unboxxed.

What is not covered by the Warranty?
For clarity, Unboxxed will not be responsible for any matter therein after the 1-
year warranty period
There must be no physical damage to the handset or its accessories (i.e.:
scratched/cracked screen or dents/marks on the body of the handset) and no
sign of neglect due to physical abuse or liquid damage.
 Any handset not purchased from Unboxxed.
 Damage to the product by use of non-Unboxxed parts
Damage to the product by accident, abuse, or misuse (outside of its intended
or permitted uses)
Damage to the product by spillage of food or liquid
Damage to the product by other external causes, including fire, an act of God
or the State, flooding, or lightning
Damage to the product by load shedding, improper voltage, or power supply
Repairs that are done without the approval of a representative of the seller
Cosmetic damage to the products after delivery
Defects or parts requiring replacement due to fair wear and tear
Any physical damage to devices with 360 (2-in-1), fold, or flip technology,
including:
Devices that have been opened beyond their intended angle.
Signs of the device being dropped or improperly handled.
